Digugat Serikat Buruh soal Seleksi Hakim, KY Tak Masalah
Komisi Yudisial (KY) tak masalah digugat Serikat Buruh Sejahtera Indonesia (SBSI) terkait seleksi calon hakim adhoc pada Mahkamah Agung (MA). Menurut KY, hal itu adalah hak asasi.
"Intinya kita menghargai, sebagai sebuah negara hukum dan organisasi yang memiliki hak untuk mengajukan gugatan. Pada prinsipnya itu adalah hak asasi dan kita menghormati proses hukum selanjutnya," kata juru bicara KY Farid Wajdi ketika ditemui detikcom di Gedung KY, Jalan Kramat Raya, Jakarta Pusat, Rabu (25/10/2017).
Gugatan SBSI terdaftar dengan nomor 216/G/2017/PTUN-JKT di Pengadilan Tata Usaha Negara (PTUN) Jakarta. SBSI mendaftarkan gugutan ini Rabu (18/10). SBSI keberatan dengan putusan KY meloloskan 5 calon hakim adhoc yang direkomendasi Konfederasi Serikat Buruh Sejahtera Indonesia (KSBSI).
"Ada putusan MA yang menyatakan bahwa dari segi penggunaan logo dan ada beberapa hal lain itu oleh putusan MA dinyatakan tidak sah KSBSI. Perdebatan kita apakah pasca putusan MA kemudian ada tindak lanjut eksekusi pembatalan pendaftaran organisasi di Dinas Tenaga Kerja Jakarta Timur. Ternyata tidak. Kita sudah ke sana," paparnya.
KY pun memastikan sudah melakukan pemeriksaan sampai ke Kementerian Tenaga Kerja dan Transmigrasi (Kemnakertrans). Menurut KY, di sana pun KSBSI masih diakui.
"Pada saat bersamaan kita melakukan perbandingan. Karena Kemenakertrans juga melakukan proses pendaftaran bagi Hakim Ad Hoc PHI di tingkat pertama, ketika kita tanya apakah kemudian pansel di sana menganulir KSBSI, tidak. Kami tidak ada keberatan dari pihak mana pun. Begitu lho maksudnya," tutur Farid.
Atas dasar tersebut, KY tetap mengikutsertakan KSBSI dalam pemberian rekomendasi calon Hakim Ad Hoc. KY menilai dari sisi legalitas yang ada di KSBSI.
"Kita punya dua, katakanlah, yurispudensi belum ada pencabutan pendaftaran atas nama KSBSI di Jakarta Timur, pada saat bersamaan di lembaga lain organisasi ini juga diakui eksistensinya. Maka kemudian pilihan kita adalah tetap menghargai proses legalitas yang dimiliki oleh KSBSI," pungkas Farid.
